All prices and quotations are submitted without offer and are subject to change without notice. A price or discount advance or decline after a sale is made shall not constitute a basis for claim in favour of or against our customer.
Terms
Net 30 days unless otherwise agreed. Mylan Pharmaceuticals ULC ("Mylan") reserve the right to charge overdue accounts past 30 days interest at the rate of 1.5% per month (18% per annum) on the outstanding balance.
Shipment
All shipments are double checked and carefully packed. Mylan's responsibility ceases after the receipt of goods in good order by transportation companies. In case of loss or damage, however, Mylan will, if requested, render aid in establishing claims and obtaining redress for our customers. If shipment upon arrival appears damaged, the bill of lading, or other pertinent forms should be so marked. All claims for shortage or breakage must be made promptly and reported to our Customer Service Department.
Product Warranty; Disclaimers
Mylan's guarantee resides in the assurance to the customer that the our products meet all applicable Health Canada requirements including the identity, safety, potency, purity, and stability of the ingredients used, the skill, experience, and care devoted to preparation, and the final pharmaceutical quality of the products offered for sale.

ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. IN NO EVENT SHALL MYLAN PHARMACEUTICALS ULC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THE SALE OR SUPPLY OF PRODUCTS, IRRESPECTIVE OF WHETHER ATTRIBUTABLE TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE.
Prohibition Against Export
Mylan products are approved by Health Canada for sale and resale in Canada only and are NOT FOR EXPORT.
Return Goods Policy
Unless otherwise required by regulation or law or expressly agreed by the parties, the following policy applies to Mylan Pharmaceutical ULC's (the “Seller's”) products.
Products Eligible for Return
1. Products eligible for return must be expired, in unopened packages and returned at any time within six months following the expiration date stated on the package.

To receive reimbursement, all eligible returns should be shipped pre-paid to the location specified by Customer Service in the applicable Return Approval.
Non-Returnable Goods
  • Non-returnable goods consist of the following (subject to Seller's discretion):
  • Merchandise sold on a non-returnable basis, marked non-returnable, free goods or with similar markings or special label.
  • Merchandise damaged by insurable catastrophes such as fire, etc. or involved in salvage, bankruptcy or fire sales. Uninsurable catastrophes will be considered on a case-by-case basis.
  • Merchandise sold, purchased, stored, or distributed contrary to Federal or Provincial law.
  • Open packages or packages from which labels have been removed or refaced in any manner.
  • Non-approved returns.
Valuation of Returns
  • For direct customers, a credit will be issued based upon the lower of the current published price at the time the returned merchandise is received by Seller or its agent OR the original invoice price net of any professional allowances, rebates, discounts including prompt payment and distribution fees.
  • For indirect customers, a refund will be issued based upon the lower of the current published price at the time the returned merchandise is received by Seller or its agent OR the original contract price at point of purchase from the wholesaler net of any professional allowances, rebates, discounts including prompt payment and distribution fees.
  • Unless otherwise agreed, credit will be issued by Seller to any direct account and a refund will be issued by Seller or its agent to any indirect account.
Miscellaneous
  • Seller reserves the right to verify all returns to make certain that they conform to this Return Goods Policy.
  • Seller reserves the right to promptly destroy any returned merchandise that is not eligible for credit or exchange.
  • Seller may require proof of purchase for all merchandise returned for credit or exchange.
  • Transportation charges, including insurance, are the responsibility of the customer unless otherwise agreed by Seller.
  • With respect to claim merchandise, an even exchange or credit will be allowed for loss or damage evident at delivery time if noted on the carrier's delivery receipt and reported to Seller within five days. Concealed loss or damage must be inspected by the carrier within 15 days after delivery and carrier's inspection report must be forwarded to Seller.
  • Subject to Seller's discretion, Seller's policy strictly prohibits any sales representative or any other employee from giving samples or stock packages to any customer to replace merchandise. All returns must be made according to this Return Goods Policy.
